Allopathic, Ayurvedic, Homoeopathic, Siddha and Unani products are all covered under the licensing framework.

The license is granted either by the State Drugs Control Authority (State Licensing Authority) for most retail, wholesale and manufacturing activity, or by the Central Drugs Standard Control Organisation (CDSCO) for matters such as new-drug approval and import. Operating without a valid license is a punishable offence under the Act, attracting imprisonment and fines.

A Drug License is an official permission issued under the Drugs and Cosmetics Act, 1940 that allows a person or business to legally deal in drugs and cosmetics in India. Depending on the activity, this may cover the manufacture, sale, stocking, distribution or import of pharmaceutical products.

The license ensures that anyone handling medicines meets the prescribed standards for premises, storage and qualified personnel, so that drugs reaching the public are genuine, safe and properly stored.

In India, drug licenses are issued by two authorities:

• State Drugs Control Authority – handles retail, wholesale and most manufacturing licenses, premises inspection and local enforcement.
• CDSCO (Central Drugs Standard Control Organisation) – handles new-drug approvals, clinical-trial permissions, import licenses and national drug-quality standards.

The drug licensing system exists to protect public health by ensuring that only safe, genuine and properly stored medicines reach consumers. Its main purposes are:

• To regulate the manufacture, sale, stocking, distribution and import of drugs and cosmetics.
• To ensure that medicines are handled only by qualified and authorised persons, such as registered pharmacists for retail sale.
• To maintain proper premises, storage and cold-chain conditions so that drugs retain their quality and effectiveness.
• To check the sale of spurious, adulterated, misbranded or substandard drugs.
• To enforce accountability and traceability across the pharmaceutical supply chain.

Selling or stocking drugs without a valid license is an offence under the Act and can lead to imprisonment and fines.

The type of drug license required depends on the nature of the business:

• Retail Drug License (RDL) – required by chemists, medical stores and pharmacies that sell medicines directly to consumers. A registered pharmacist must be present.
• Wholesale Drug License (WDL) – required by businesses that sell or distribute medicines to retailers, hospitals or other wholesalers. A competent person with the prescribed qualification/experience is required (a registered pharmacist is not mandatory).
• Manufacturing License – required by units that manufacture drugs, including allopathic, Ayurvedic, Homoeopathic or cosmetic products, subject to GMP compliance.
• Loan License – granted to a person who does not own a manufacturing facility but uses the premises and plant of another licensed manufacturer to produce drugs under their own brand.
• Import License – required to import drugs or cosmetics into India, granted by CDSCO.

Forms commonly used include Form 19 (application to sell), Form 20/21 (retail sale of allopathic drugs) and Form 20B/21B (wholesale).
