An FSSAI State License is the mandatory food licence issued by the State Food Safety Authority under the Food Safety and Standards Act, 2006. Every Food Business Operator (FBO) of medium scale operating within a single state must hold this licence to legally manufacture, process, store, distribute, transport or sell food in India.

A State Licence applies to mid-sized food businesses whose annual turnover falls above the FSSAI Registration limit and below the Central Licence limit (broadly, businesses larger than petty operators but not operating across multiple states or at the largest scale, as per current FSSAI turnover norms). Typical applicants include medium scale manufacturers, processors, packers, repackers, restaurants, hotels, caterers, transporters, wholesalers, distributors and storage units.

The licence is granted on the FoSCoS portal (Food Safety Compliance System) and carries a unique 14-digit licence number that must be displayed and printed on food packaging. It assures consumers and regulators that the business meets prescribed hygiene and food-safety standards. Operating without a valid licence is a punishable offence under the Act.

A State Licence is meant for medium scale food businesses operating within a single state whose turnover exceeds the Basic Registration threshold but stays below the Central Licence threshold (as per current FSSAI turnover norms; businesses above the upper limit or operating in multiple states require a Central Licence). It commonly applies to:

• Food manufacturers and processing units of medium scale
• Packers, repackers and relabellers
• Restaurants, hotels, clubs, canteens and caterers
• Wholesalers, distributors and suppliers
• Storage units, cold stores and warehouses (within prescribed capacity limits)
• Transporters operating within the state
• Marketers, retailers and importers operating within a single state under the State limits
• Dairy, meat, vegetable oil and other specified units within the State-scale capacity

If turnover is below the Registration limit, a Basic FSSAI Registration is sufficient; if turnover crosses the upper limit or the business operates across more than one state, a Central Licence is required instead.

Government fee: The State Licence fee is paid per year and varies by the Kind of Business and capacity (for example, manufacturing units are charged according to their production capacity). The fee is payable in advance for the number of years selected, as per the prescribed FSSAI fee schedule on FoSCoS. Professional / service charges, if any, are separate from the government fee.

Penalties for non-compliance:

• Operating a food business without a valid licence is an offence under Section 63 of the FSS Act, which can attract imprisonment and a substantial fine (up to several lakh rupees as prescribed by law).
• Other contraventions, such as selling sub-standard or misbranded food, attract separate monetary penalties under the Act.
• Late renewal attracts a daily late fee as notified by FSSAI.
• Failure to meet ongoing conditions (including any required annual compliance filing) can lead to suspension or cancellation of the licence.

FSSAI follows a risk-based approach to licensing, inspection and oversight rather than treating all food businesses alike. Food businesses are classified broadly into high-risk, medium-risk and low-risk categories based on the nature of food handled and the type of operation.

• High-risk foods — such as dairy, meat and poultry, fish and seafood, eggs and ready-to-eat products — face stricter conditions and more frequent inspections due to higher contamination potential.
• Inspection frequency is determined dynamically using factors like the kind of food handled, the FBO's past compliance and enforcement history, self-compliance results and third-party audit outcomes.
• Compliant, lower-risk businesses benefit from fewer inspections, while high-risk or non-compliant businesses are monitored more closely.
